REFUND POLICY

This Refund Policy (“Policy”) is issued by Sunmax Energy, operated by Yasha Terra Ventures, having its registered office at Samarpan, Savitribai Phule Nagar, Pant Nagar, Ghatkopar East, Mumbai, Maharashtra - 400075, hereinafter referred to as “Sunmax Energy,” “we,” “us,” or “our.”
This Policy governs the terms under which refunds shall be processed for transactions conducted through the Sunmax Energy website and associated platforms (“Platform”).
This Policy is formulated in accordance with the Consumer Protection Act, 2019 and applicable rules thereunder.
1. Scope
This Policy applies to:

Solar panel cleaning services booked via the Platform.

On-site solar inspection or maintenance services.
-
Advance booking payments made for scheduled cleaning services.
-
Any ancillary solar-related services offered by Sunmax Energy.
2. Refund Eligibility
Refunds shall be considered under the following circumstances:
a) Service Cancellations
Cancellation by Sunmax Energy:
Cancellation by Client:

Full refund if cancelled at least 24 hours prior to the scheduled service time.

No refund if cancelled less than 24 hours before the scheduled appointment.

In case the service team reaches the site and service is refused or access is denied, the visit shall be treated as completed and no refund shall be issued.
b) Service Not Rendered

Full refund if the service could not be completed due to technical failure attributable to Sunmax Energy.

If service is partially completed, refund shall be issued proportionately for the uncompleted portion.
c) Weather & Force Majeure

In case of extreme weather (heavy rain, storm, unsafe roof conditions), service may be rescheduled without penalty.

Refunds shall not be issued for delays caused by weather; rescheduling shall be the primary remedy.
d) Non-Refundable Situations
Refunds shall not be granted in the following cases:

Services already rendered.

Dissatisfaction arising from generation expectations beyond industry norms.

Solar output variations due to weather, shading, inverter faults, wiring issues, or system defects unrelated to cleaning.

Access restrictions at the site preventing safe execution.
-
Promotional or discounted services unless service was not delivered.
3. Performance Disclaimer
Sunmax Energy may provide indicative improvement projections based on industry observations. However:

Actual generation increase may vary depending on environmental conditions and system health.

Cleaning improves panel efficiency but does not guarantee specific financial returns beyond reasonable performance restoration.

Sprinkler or robotic cleaning systems may not remove hardened residues such as bird droppings; professional cleaning addresses such surface soiling within safe operational limits.
4. Refund Process

Refund requests must be submitted via email to support@sunmaxenergy.in within 03 days of the scheduled service date.

Requests must include booking reference, payment receipt, and description of issue.

Verification shall be completed within 02 working days.

Approved refunds shall be processed within 05 working days via the original payment method.

Refund confirmation shall be communicated via email or SMS.
Refunds shall be processed inclusive or exclusive of GST as applicable and in compliance with GST regulations. Any GST remitted shall be adjusted as per statutory provisions.
5. Obligations of Users
Users must:

Provide accurate booking and payment details.
-
Ensure safe and accessible rooftop conditions.
-
Cooperate with service personnel during verification.
-
Avoid misuse of refund claims.
Repeated or fraudulent refund claims may result in suspension of service eligibility.
6. Obligations of Sunmax Energy
Sunmax Energy shall:

Ensure fair, transparent, and timely refund processing.
-
Maintain records of refund transactions for audit and compliance.
-
Provide clear communication regarding status updates.
-
Deploy trained personnel using safe cleaning practices.
7. Limitation of Liability

Sunmax Energy shall not be liable for delays caused by banking institutions or payment gateways.

Refunds shall not exceed the original transaction amount.

Sunmax Energy shall not be responsible for indirect, incidental, or consequential losses.

Sunmax Energy acts as a service provider and shall not be liable for pre-existing defects in solar systems, inverter malfunctions, structural weaknesses, or electrical faults.
8. Governing Law & Jurisdiction
This Policy shall be governed by and construed in accordance with the laws of India.
Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
